(AP) ? With every swing and miss, this looked as if it might be the day Yu Darvish pitched a no-hitter against the overmatched Houston Astros.

And then with one out in the eighth inning, Carlos Corporan ended Darvish's latest bid with a home run.

Darvish once again neared perfection versus Houston, striking out a career-high 15 and permitting only one hit in eight innings as the Texas Rangers won 2-1 Monday for their season-high eighth straight victory.

"A win's a win," Darvish said through a translator. "I'm just glad I was a big part of this win."

Texas won for the 13th time in 14 games and headed home atop the AL West.

In early April, Darvish (12-5) was one out away from a perfect game at Minute Maid Park before Marwin Gonzalez singled between his legs. Darvish joined Nolan Ryan as the only pitchers in team history to have more than one start of at least eight innings with one hit or less.

Darvish became the first pitcher to have two no-hitters broken up in the eighth inning or later since it happened to Justin Verlander in 2011.

Outfielder Alex Rios chased Corporan's drive to the wall, but had to watch as it sailed about five rows into the stands. Darvish simply looked around, and then wiped his brow with his arm before preparing to throw his next pitch.

"Well, I'd like to see it happen of course," manager Ron Washington said. "But those are professional hitters over there, too, and Corporan caught one."

Until the homer, Houston's lone runner came when rookie Jonathan Villar drew a two-out walk on a full count in the sixth. Texas catcher A.J. Pierzynski was ejected for arguing with plate umpire Ron Kulpa about a 2-2 breaking pitch he called low ? Pierzynski was tossed after Villar walked.

"Was it a strike? I don't know," Pierzynski said. "Obviously I thought it was and Ron didn't, and I was upset we walked the guy and I said a bad word and I was ejected."

Darvish was perplexed by the actions of his catcher.

"When he got ejected, I thought, 'What is he doing?" Darvish said with a laugh.

The two-time All-Star ace from Japan was sharp all game, retiring the last two batters in eighth and exiting after increasing his major league-leading strikeout total to 207.

"He used everything today: slider, curveball, cutter, fastball," Washington said. "He moved it around, kept them off-balance. When they were looking for breaking balls he was throwing fastballs and cutters and when they were looking for cutters he was throwing breaking balls."

"I was pretty locked in," he said.

Darvish struck out 14 in four prior games this year, including his earlier gem at Houston. His 15 strikeouts on Monday matched his career-high from his professional career in Japan.

He is 3-0 with a 1.52 ERA and 37 strikeouts in three starts in Houston this season, and is 4-1 with a 1.31 ERA and 50 strikeouts in five starts since returning from the disabled list.

Joe Nathan pitched a perfect ninth for his 35th save.

The AL West-leading Rangers took a quick lead over the last-place Astros. With two outs in the first, Ian Kinsler and Adrian Beltre doubled and Pierzynski hit an RBI single off Brett Oberholtzer (2-1).

Oberholtzer yielded seven hits and two runs with six strikeouts in 6 2-3 innings for his first loss in three major league starts.

The Houston hitters had no such luck with Darvish.

Darvish was strong from the start relying mostly on a four-seam fastball, sliders and a cutter against the Astros' inexperienced lineup.

"He doesn't just have control. This guy has command," Houston manager Bo Porter said. "He can throw every pitch the way he wants to throw it, even out of the strike zone. Which, when you have that kind of repertoire, you're going to be up against it."

He struck out the side in the first inning before getting two fly outs and a ground out in the second.

The 26-year-old righty fanned two each in the third and fourth innings, struck out the side in the fifth and the first batter of the sixth inning. His strikeout of Chris Carter to start the fifth was his 200th of the season, giving him a team record for fewest games (23) needed to reach the mark.

In the sixth, Darvish started walking off the mound after his close pitch to Villar. Pierzynski also began heading to the dugout, but Kulpa said it missed.

Pierzynski didn't like the call. After the walk, started yelling in Kulpa's face and was quickly tossed. Geovany Soto took over at catcher.

Darvish, a two-time MVP in Japan, flirted with perfection last Sept. 3, too, retiring the first 17 batters at Kansas City.

NOTES: Injured Texas DH Lance Berkman is getting Monday off and will DH for Double-A Frisco on Tuesday and Wednesday and will be re-evaluate him after that. ... Neftali Feliz, who was expected to throw Saturday for Round Rock but did not pitch as a precaution because of mild right arm triceps tendinitis, has been shut down. Feliz has been rehabbing from Tommy John surgery last year. ... Darvish set rookie franchise records for wins (16) and strikeouts (221) last season. He finished third in AL Rookie of the Year voting behind winner Mike Trout and Oakland outfielder Yoenis Cespedes.

(AP) ? Israel on Monday published the names of 26 Palestinian prisoners, most of them jailed for killings and deadly attacks, who are to be released this week as part of a U.S.-brokered deal that led to a resumption of Mideast negotiations.

Israelis and Palestinians are to launch talks in Jerusalem on Wednesday, following a preparatory round two weeks ago in Washington. The prisoner release is part of an agreement to restart the talks after a five-year freeze.

Israel's Prison Service posted the names of 26 prisoners online early on Monday to allow two days for possible court appeals.

Twenty-one in the group were convicted of killings, including of Israelis and suspected Palestinian collaborators, while others were involved in attempted murder or kidnapping.

Half the prisoners on the list had no given release date, meaning they were serving full life terms, while others would have been released in a few years without the special deal. Most have already served around 20 years, with the longest-held arrested in 1985.

Tens of thousands of Palestinians have spent time in Israeli prisons on security charges since Israel's capture of the West Bank, Gaza and east Jerusalem in 1967.

Most Palestinians view prisoners as heroes, regardless of their acts, arguing they made personal sacrifices in the struggle for independence.

Many Israelis view those involved in killings as terrorists for killing civilians.

Among the victims of the prisoners slated for release are an Israeli lawyer stabbed to death in a European aid office in Gaza in 1993 and an American, Frederick Steven Rosenfeld, who was stabbed to death while hiking in the West Bank in 1989

It is a "sad day for bereaved families and for Israeli society," said Meir Indor, who heads a group of victims' families.

In all, 104 long-held prisoners are to be released in four stages over the course of Israeli-Palestinian negotiations, envisioned to go on for about nine months.

Kadoura Fares, who heads a prisoners' advocacy group, said he was disappointed some of the longest-held among the 104 weren't on the list.

The U.S. envisions an agreement within nine months on the terms of a Palestinian state alongside Israel, including drawing a border, agreeing on security arrangements and deciding the fate of Palestinian refugees.

The Palestinians want a state to include the territories Israel captured in 1967.

The diplomatic paralysis of the last five years was largely due to disputes over the construction of Israeli settlements in areas the Palestinians want for a future state.

Palestinian President Mahmoud Abbas has long insisted he will only resume talks if Israel freezes construction. Israeli Prime Minister Benjamin Netanyahu rejected a freeze.

U.S. Secretary of State John Kerry eventually brokered the resumption of negotiations, and Abbas dropped a settlement freeze as a condition for talks.

In exchange, Kerry won Israeli agreement that it will release 104 Palestinian prisoners.

The upcoming release drew anger from relatives of those killed by the prisoners.

"These are not political prisoners they are terrorists and murderers who will be returning home to a hero's welcome, said Gila Molcho, whose brother, lawyer Ian Feinberg, was stabbed in the European aid office in Gaza 20 years ago.

"They will be celebrating the killers of our brothers and children," she told Israeli Channel 2 TV.

Religious family survives being lost at sea

PHOENIX (AP) ? A northern Arizona family has survived being lost at sea for weeks after an ill-fated attempt to leave the U.S. over what they consider government interference in religion.

Hannah Gastonguay and her family will fly back home Sunday after taking their two small children and her father-in-law and setting sail from San Diego for the tiny island nation of Kiribati in May.

Weeks into their journey, the Gastonguays hit a series of storms that damaged their small boat, leaving them adrift for weeks, unable to make progress. They were eventually picked up by a Venezuelan fishing vessel, transferred to a Japanese cargo ship and taken to Chile.

Their flights home were arranged by U.S. Embassy officials, Gastonguay said. The U.S. State Department declined to comment on Sunday.

The months-long journey has been "pretty exciting" and "little scary at certain points," Gastonguay told The Associated Press by telephone.

The 26-year-old mother said they wanted to go to Kiribati because "we didn't want to go anywhere big." She said they understood the island to be "one of the least developed countries in the world."

Kiribati is a group of islands just off the equator and the international date line about halfway between Hawaii and Australia. The total population is just over 100,000 people of primarily Micronesian descent.

Hannah Gastonguay said her family was fed up with government control in the U.S. As Christians they don't believe in "abortion, homosexuality, in the state-controlled church," she said.

U.S. "churches aren't their own," Gastonguay said, suggesting that government regulation interfered with religious independence.

Among other differences, she said they had a problem with being "forced to pay these taxes that pay for abortions we don't agree with." While federal law bars public funding for abortion, state attempts to block Medicaid funding for organizations that provide the procedure have met with legal hurdles. Opponents say that funding allows those groups to perform abortions.

The Gastonguays weren't members of any church, and Hannah Gastonguay said their faith came from reading the Bible and through prayer.

"The Bible is pretty clear," she said.

The family moved in November from Ash Fork, Ariz., to San Diego, where they lived on their boat as they prepared to set sail. She said she gave birth to the couple's 8-month-old girl on the boat, which was docked in a slip at the time.

In May, Hannah, her 30-year-old husband Sean, his father Mike, and the couple's daughters, 3-year-old Ardith and baby Rahab set off. They wouldn't touch land again for 91 days, she said.

She said at first, "We were cruising."

But within a couple of weeks "when we came out there, storm, storm, storm."

The boat had taken a beating, and they decided to set course for the Marquesas Islands. Instead, they found themselves in a "twilight zone," taking more and more damage, leaving them unable to make progress.

They could have used a sail called a genoa, she said, but they risked snapping off the mast and losing their radio and ability to communicate.

They had been on the ocean for about two months and were low on supplies. They were out of food and were down to "some juice and some honey." She said they were able to catch fish, but they didn't see any boats.

Still, we "didn't feel like we were going to die or anything. We believed God would see us through," she said.

At one point a fishing ship came into contact with them but left without providing assistance. A Canadian cargo ship came along and offered supplies, but when they pulled up alongside it, the vessels bumped and the smaller ship sustained even more damage.

They were getting hit by "squall after, squall, after squall."

"We were in the thick of it, but we prayed," she said. "Being out on that boat, I just knew I was going to see some miracles."

They watched the surrounding storms disperse, and "next thing you know the sun is out. It's amazing."

Eventually, their boat was spotted by a helicopter that had taken off from a nearby Venezuelan fishing vessel, which ended up saving them.

"The captain said, 'Do you know where you're at? You're in the middle of nowhere,'" she said.

They were on the Venezuelan ship for about five days before transferring to the Japanese cargo ship, where they were for nearly three weeks before landing in Chile on Friday. The Chilean newspaper Las Ultimas Noticias reported the story of their arrival.

"They were looking for a kind of adventure. They wanted to live on a Polynesian island but they didn't have sufficient expertise to navigate adequately," police prefect Jose Luis Lopez told the newspaper. Lopez took the family's statement in San Antonio, Chile, where the Japanese ship had dropped off the family.

Mauricio Araneda, the governor in Chile's San Antonio province, told the AP that the family "had zero knowledge and experience in navigation."

Sean Gastonguay's brother Jimmy, who lives in Arizona, said he had provided a description of the family's vessel to the U.S. Coast Guard and exchanged emails with them once they were picked up by the first boat.

"There was some concern, but we were hoping for the best, and they eventually popped up," he said. He was able to keep track of the family with the help of the Coast Guard as they were transferred from ship to ship.

"We're all happy. We have good peace of mind now," he said.

Hannah Gastonguay said the family will now "go back to Arizona" and "come up with a new plan."

Indonesia volcano erupts, killing six people | World news ...

Indonesia's National Disaster Mitigation Agency said a volcano has erupted in eastern Indonesia, killing six people and shooting smoke and ash up to 2km (1.2 miles) into the air.

The agency said that Mount Rokatenda in East Nusa Tenggara province erupted early on Saturday morning and that the five were killed by lava flow.

Nearly 3,000 people have been evacuated from the area on Palue island. The volcano has been rumbling since October 2012.

Indonesia, an archipelago of 240 million people, is prone to earthquakes and volcanic activity because it sits along the Pacific "ring of fire", a horseshoe-shaped series of fault lines.

D.C. Notebook: Huntsman on 2012 GOP field: This is the best we have?

D.C. Notebook: Huntsman on 2012 GOP field: This is the best we have?

As was pretty clear to those who watched, Jon Huntsman wasn?t thrilled with the presidential race last year. The one-time candidate was critical of his own party after he dropped out of the race for the GOP nomination and has since had choice words for the entire process.

In Collision 2012, a new book by The Washington Post?s Dan Balz, Huntsman makes it clear he wasn?t a big fan of the Republican field.

"What went through my head ? and I hope this doesn?t sound egotistical ? what went through my head was in this country of 315 million people, Nobel Prize winners, university presidents, CEOs, creative class leaders, innovators, great people, this is what we get to run for president? This is it? ? They?re all good people, but they?re not the best that this country has to offer."

Huntsman, of course, didn?t say that during the race, but it would have made for one heckuva debate line.

Poll: NSA good, spying bad ? Most Utahns support the National Security Agency setting up shop in the state, though nearly half of residents believe the spy agency is violating constitutional protections by snooping on Americans, a new poll shows.

Some 54 percent of those surveyed by the libertarian Libertas Institute last week say they strongly or somewhat support the NSA?s new Utah Data Center set to open this fall, while 33 percent oppose the mammoth center near the Point of the Mountain.

Meanwhile, 46 percent of the same group surveyed said they believe the NSA has violated the Constitution?s Fourth Amendment protections against unreasonable searches and seizures. Only 26 percent said the agency wasn?t doing that.

Connor Boyack, president and founder of the group that set up his own calling system to conduct the poll, said the results were a bit shocking.

"We were stunned to see so many Utahns oppose the NSA?s activities on Fourth Amendment grounds, yet express support for their facility in our backyard where the results of these activities will evidently be stored, harvested, and used in ways that further violate the Fourth Amendment," Boyack said. "To us, it suggests a bit of a disconnect."

story continues below

On another survey question, it?s clear that Utahns aren?t fans of the anti-terrorism policies instituted since the Sept. 11, 2001, terrorist attacks. Some 48 percent say the policies go too far while 18 percent say they don?t go far enough.

Reality TV? ? HBO?s The Newsroom is treading into the 2012 presidential campaign in its new season and Mitt Romney?s campaign isn?t shown in the best light so far.

In a recent episode of the fictional show, TV producer Jim Harper is covering the Romney express as it winds through New Hampshire but is twice rebuffed on his attempt to board the press bus by a Romney aide who isn?t a big fan of Harper?s news outlet. When he finally gets on, Harper presses Romney spokespeople for answers that go beyond their talking points and ends up getting kicked off the bus with two other reporters.

A former 2012 Romney spokesman says that is obviously pure fiction.

"You all would have heard about that if it had happened" in the real campaign, says Ryan Williams, a Romney campaign spokesman who traveled with the former Massachusetts governor. The show "doesn?t seem to be very close to the truth," he adds.

If there was space, Williams says, legitimate news outlets ? even those who were super-critical ? were welcomed aboard the campaign?s press bus or on the campaign planes. At one point, some reporters covering Romney had to take a separate press plane but that was only because so many journalists were traveling with the Republican candidate, Williams notes.

The show?s creator is left-winger Aaron Sorkin, who also created The West Wing series wherein Republicans were often the butt of jokes, so GOPers aren?t shocked to see the Obama campaign so far immune from the show?s jousts.

On another front, Williams says that several in the Romney press shop were trying Monday to figure out if certain characters are based on real-life people ? is Romney?s sharp, female mouthpiece supposed to be national press secretary Andrea Saul? ? but there isn?t likely to be a big following among the Romney alum.

"The whole concept seems a little silly to have a fictional account of a campaign that happened in real life," Williams said.

The HBO show rankled Utah Sen. Mike Lee when it debuted last year and referred to the freshman tea partyer as wanting to jettison the constitutional amendment that allows anyone born in the United States to be a citizen. Lee phoned the president of HBO asking for a clarification, though none was apparently broadcast.

Enterprise Spatula: Boldly Go Where No Fry Cook Has Gone Before

With replicators in every room, the crew of the U.S.S. Enterprise technically didn't need to cook anything while away on their missions. But such technology is well beyond our grasp at the moment, and the daily task of prepping meals is thankfully made slightly less mundane when you've got the Enterprise in hand to flip flapjacks.

3 Ways to Go About Making Your First Investment - CashNetUSA.com

If you?re not in a position to have an employer make investments in a 401(k) on your behalf, you may not have ever invested in anything before, other than stashing some money in a bank savings account now and then. With interest rates where they are, those funds are losing money to inflation, so that?s more of a preservation of cash rather than an actual investment.Making Your First Investment

Here we?ll talk about three different ways to get started, which could be especially helpful for young adults who may not have employer options just yet:

  • Mutual Funds ? Mutual funds are typically a basket of many stocks that a fund manager buys so that the risk of the fund failing as a whole is quite low. The way the valuation works is that there?s a ?Net Asset Value,? which is the mix of all the returns of the various stocks held in the fund that gets set at market close each day. The reality is that most of the time, there are so many stocks held in a mutual fund that the total return pretty much tracks major market indices like the Dow Jones industrial average. That begs the question of whether you should invest in ?actively managed? funds or ?passive index? funds. Actively managed funds use a fund manager to try and pick the best stocks and beat the index, while passive index funds just invest in whatever the established stock market index is, meaning there is no discretion over which stocks to pick. What the data show is that most active managers can?t beat the index, yet have higher expenses in their funds, so most investors are probably better off using index mutual funds.
  • Individual Stock Investing ? Many individual investors prefer to buy stock in companies they know and are passionate about. For instance, when the iPhone was becoming popular, many investors were rewarded with great returns by investing in Apple stock. Unfortunately, of late, the very same stock that did so well in past years has crumbled, so it just shows that hot stocks can fall quickly. Many investors try individual stock picking at some point in their lives and then switch to lower cost index investing, realizing they can?t do any better than professional money managers, who often can?t beat the market anyway.
  • ETFs ? Exchange Traded Funds are a good diversion from individual stock investing and mutual funds. ETFs trade just like stocks in real-time on stock exchanges, but they are comprised of many stocks or commodities all in the same basket. But unlike mutual funds, which can only be bought and sold once per day based on the daily close of all their holdings, ETFs can be traded during the day. They also have many different ?themes? or categories. So there are ETFs for company spinoffs, the price of gasoline, and even solar companies. Investors that believe a particular investment trend or theme will be big in the future can invest in a themed ETF with a regular online trading account just like stocks, but they have the added benefit of diversification across multiple companies within the ETF.

There?s no single correct approach to determining the investments you should hold, but I?m of the opinion that initial investors should focus on keeping the costs low and avoiding too much risk with an individual stock, which would favor either mutual funds or ETFs.

Guinness tackles sliding sales with new attraction

8th August, 2013 by Gabriel Savage

The Tasting Rooms GuinnessThe move comes as owner Diageo steps up its wider marketing investment in Guinness to help revive the brand?s flagging sales across the UK and Ireland, which contributed to a global volume decline of 2% last year.

Forming part of The Guinness Storehouse, a seven storey venue which claims the title of Ireland?s number one international visitor attraction, The Tasting Rooms are described as ?the world?s most unique and innovative Guinness tasting experience.?

Visitors pass through a series of spaces which combine ?scientific and creative elements? designed to help enhance their appreciation of the famous Irish stout?s distinctive flavour.

The Tasting Rooms join the venue?s existing features such as the Guinness Academy and Guinness Connoisseur Bar, as part of an attraction where visitors can learn to pour the perfect pint, taste Guinness-inspired dishes or enjoy a 360? view of Dublin from Gravity Bar.

?The unveiling of The Tasting Rooms here in the Guinness Storehouse marks an exciting development into the realms of experiential and sensory tasting innovation,? said the venue?s visitor experience manager Catherine Keegan.

?We?re thrilled to be bringing such a unique and alternative experience to visitors from both Ireland and across the globe.?

This latest investment in the brand comes after Diageo reported a 2% overall volume decline for Guinness in its preliminary annual results to the end of June 2013.

Despite Diageo reporting a ?resilient? picture from Great Britain as a whole in its preliminary annual results to the end of June 2013, Guinness sales here fell by 3%, with a 5% fall in Ireland. However, the drinks group marked an improvement for the brand in both markets during the final quarter thanks to a step-up in marketing investment.

?

By contrast, Guinness enjoyed net sales growth of 19% in East Africa and 13% in South East Asia.

MSI reveals the world's thinnest 17 inch gaming laptop | Lazygamer ...

Thinner (2)

Even though I know I?ll most likely have my kneecaps broken with an old Pentium 486 PC in a dark alley for admitting that I love gaming laptops, it?s still worth posting this. MSI Computer Corp has a new mobile gaming platform on the way, and that laptop happens to be thinner than Pep store-brand toilet paper.

The GS70 is a 17 inch beast that happens to be just .85 inches thin. That?s pretty damn svelte, considering that the laptop happens to be packing an Nvidia GeForce GTX 765M card and a fourth generation Intel Core i7 processor.

imageb (1)

The GS70 will be out in 750GB and 1TB models as well, costing gamers $1799 and $1999 respectively. Both models share the same features though, such as three audio jacks, a 720p HD camera and 16GB of DDR3L RAM. And all of that, in a package that weighs just 2.5 KG.

That?s pretty damn impressive overall, although when it comes to a lack of girth, Razer has MSI beat with their 14 inch Blade laptop that happens to be even thinner ? but has 3 inches less screen real estate.?

Rouhani becomes new Iranian president

By Yeganheh Torbati and Marcus George

Moderate cleric Hassan Rouhani took office as Iran?s president on Saturday, succeeding Mahmoud Ahmadinejad, after Supreme Leader Ayatollah Ali Khamenei endorsed him, Iranian media said.

Rouhani?s resounding election win in June raised hopes of a negotiated end to the dispute over Iran?s nuclear programme. That would avert a possible new war in the Middle East.

Khamenei kissed Rouhani on the cheek and the new president kissed the leader on his lapel.

The start of Rouhani?s presidency puts an end to Ahmadinejad?s eight years in office during which Iran grew more isolated and came under wide-ranging United Nations, U.S. and European Union sanctions over its nuclear programme, putting enormous pressure on the economy.

Rouhani faces huge challenges, including combating inflation he put last month at 42 percent, bringing down high unemployment and bridging the political divisions between conservative, moderate and reformist factions.

His most immediate test is persuading parliament to approve his candidates for cabinet positions, which he is expected to introduce on Sunday after he takes the oath of office.

?Rouhani will certainly appoint more competent men and women to key economic ministries and institutions. He will also follow saner economic policies,? said Shaul Bakhash, an Iran historian at George Mason University in Virginia.

?But the economic problems are staggering ? Above all, without a serious easing of sanctions, it is difficult to see how Rouhani can get the economy moving again.?

Ask AC: How do I cancel my Google Play Music All Access subscription?

Google Play Music

If Google Play Music All Access isn't for you, cancelling it is easy

We spend a lot of time talking about how much we're enjoying the Google Play Music All Access subscription service, but it's also important to know how to cancel it if you've given it a try and decided it's not for you. We don't judge, there are several good reasons to not want or need access to Google's music catalog, and that monthly fee adds up if it's not something you want.

Luckily, cancelling is pretty easy.?

Grab your Android, and fire up the Google Play store app. Head to the store page for Google Play Music, either by searching for it or by finding it in the My Apps list. On the page for the app, near the top, you'll see the cancel button. Tap it and follow the directions. When you're finished, you'll not be billed the next time your installment date rolls around and your subscription will end.

It's worth noting that if you cancel and want to come back, you'll lose any introductory price promotion you may have now for joining the program early. You also won't be able to try 30 days for free more than once, so if that's your goal you'll need to devise another plan. Google wasn't born yesterday.

Have a question you need answered? (Preferably about Android, but we're flexible.) Hit up our Contact Page to get in touch!

Facebook closes above IPO price

Daniel Acker / Bloomberg

Facebook boss Mark Zuckerberg.

Facebook stock closed above its initial offering price on Friday for the first time since the company's IPO, at $38.05, and it was continuing to climb in after hours trading.

The Menlo Park social network's stock (NASDAQ: FB) has risen 50 percent since a stronger than expected second quarter earnings report on July 24, with the growth in mobile advertising revenue particularly impressive.

The all time high for Facebook was $45 per share on May 18, 2012, the day of its IPO, after which prices quickly dropped, hitting as low as $17 per share on Sept. 4 of that year.

Dell shareholders convene a third time as buyout battle escalates

By Eileen O'Grady and Poornima Gupta

ROUND ROCK, TEXAS/SAN FRANCISCO (Reuters) - Dell Inc shareholders convene for a third time on Friday to vote on CEO Michael Dell's $24.4 billion buyout, helping decide the fate of the No. 3 PC maker after months of dueling with Carl Icahn and other unhappy investors.

The meeting in Round Rock, Texas, comes after two previous adjournments, when the company wasn't certain of gaining enough votes for what would be the largest buyout since the financial crisis.

Unless it's postponed again, Friday's vote may prove crucial in determining the future of the struggling company. Its founder and private equity firm Silver Lake want to buy and take the company private, arguing that a painful restructuring can best be performed away from Wall Street's scrutiny.

But the battle over that deal, announced in February, has raged for months, casting a pall of uncertainty over a company already shrinking along with a rapidly declining PC market.

The CEO, his advisers and proxy solicitors have gone back and forth with shareholders whose votes are needed to secure the deal. They've had some success, managing to get prominent investors such as BlackRock Inc. and Vanguard onboard.

But activist investor Icahn, who views Michael Dell's $13.65-a-share offer as too low, has amassed an 8.7 percent stake in the company and is leading an opposing charge with Southeastern Asset Management, with an offer of his own.

He has campaigned hard to get Dell to set a date for an annual shareholder meeting so he can put up his own slate of directors for the company.

On Thursday, he fired his latest broadside, suing Dell Inc and its board to try to block substantial changes to the CEO's buyout offer that may affect the outcome of any shareholder vote and force the company to set a date for an annual meeting.

Dell shares are expected to fall sharply if the deal falls through. On Thursday, they closed just below $13.

ROUND AND ROUND

Sources say the outcome of any vote remains a toss-up unless the deal's terms are changed. Michael Dell has proposed a higher $13.75-a-share, but only if the company's special committee -- appointed to review the deal -- agrees to change voting rules to exclude abstentions from the count.

Abstentions currently count as "no" votes, and with an estimated quarter of eligible shares not having voted either way so far, that's a substantial hurdle to overcome.

The special committee, however, rejected that requirement after several major shareholders expressed outrage. Instead, the committee offered to change the record date, or the date at which a shareholder is considered eligible to vote.

Such a change is also considered beneficial to getting the deal pushed through, because a later record date would bring a lot of so-called arbitrage investors into the game, who are deemed more likely to want a deal.

In the longer term, investors remain divided over Dell's prospects. Some are ready to cash out of a company increasingly vulnerable to a crumbling PC market. The company created by Dell in his dorm room in 1984, and which rapidly grew into a global market leader renowned for innovation, is a now shadow of its former self.

Others, led by Icahn and Southeastern Asset Management, are convinced the company still has time to transform itself into a dominant provider of business computing services.

Icahn has accused the company of resorting to "scare tactics" by disclosing bad news and dismal forecasts. Dell reported a 79 percent drop in profit in its latest quarterly report.

Councilman Hotchkiss Thrown From Horse Before Parade

By Giana Magnoli, Noozhawk Staff Writer | @magnoli |

Santa Barbara City Councilman Frank Hotchkiss was thrown off his horse in the staging ground for the Old Spanish Days Historical Parade on Friday, and was taken to the hospital for treatment of his injuries, according to the Santa Barbara City Fire Department.

Firefighters and paramedics responded to the call at about 11:45 a.m., and took Hotchkiss to Santa Barbara Cottage Hospital as a precaution, since head and neck injuries are a big concern when falling from that height, fire Battalion Chief Robert Mercado said.

?It?s a big distance,? he noted.

Hotchkiss, reached by telephone Friday afternoon, said most of his lower left back was very sore, and hospital staff were checking to make sure nothing was broken, but he hopes to be up and about in a day or two.

?I was at Pershing Park before the parade,? he said. ?It?s a good thing, too; all of a sudden my horse shied and bucked me kind of straight up in the air. I landed flat on my back on the grass.?

He has ridden horses many times before, but had never been on that particular horse, he said.

The animal apparently was spooked when Hotchkiss pulled off his hat to wave to someone.

The Historical Parade is one of the largest equestrian parades in the country, and has hundreds of riders on horseback making their way up State Street every year for Old Spanish Days.

City firefighters also responded to an incident involving a fall from a horse near the end of the parade on Micheltorena Street, Mercado said. A man and woman were riding the same horse and it's unclear whether the horse tripped or was spooked, but both people ended up on the ground, according to City Fire.?

Both people were taken to the hospital on backboards, as a cervical spine precaution. They complained of back and neck pain, responding firefighters said. It's normal for City Fire to respond to a few incidents at the parade every year, though the riders who come out for Fiesta are usually very experienced, they noted.?

RI home lived in while family was on vacation - Times Union

BARRINGTON, R.I. (AP) ? In a stunt straight out of "Goldilocks and the Three Bears," a Rhode Island family came home from a weeklong vacation to find that someone had been living in their house.

Tracy Woodard of Barrington tells WJAR-TV (http://bit.ly/12I4Kim ) the family found wet towels and blankets strewn about the house, someone's underwear on the couch, and condom wrappers and marijuana left behind. She says whoever broke in also made cookies.

The family says the intruders took alcohol, cash and other valuables from the home and caused damage, including breaking some doors.

Woodard says the unwanted guests had taped blankets over the home's glass doors so neighbors couldn't see in.

Barrington police Chief John LaCross says officers are investigating, but no arrests have been made.

U.S. employers add 162,000 jobs, rate falls to 7.4 percent

By The Associated Press

Published: Friday, August 2, 2013, 8:42?a.m.
Updated 15 minutes ago

WASHINGTON ? U.S. employers added 162,000 jobs in July, the fewest since March. The gains were enough to lower the unemployment rate to a 4 1?2 -year low of 7.4 percent, a good sign in an otherwise lackluster report.

The Labor Department said Friday that unemployment fell from 7.6 percent in June as more Americans found jobs.

Still, the economy created 26,000 fewer jobs in May and June than previously estimated. Americans worked fewer hours in July, and their pay dipped. The figures suggest weak economic growth may be making businesses cautious about hiring.

Job growth for the year still remains solid. The economy has created 200,000 jobs a month since January. However, the pace has slowed in the past three months to 175,000.

?A clearly weaker-than-expected report, but one should not overstate it ? the unemployment rate continues to trend down and average job growth of 175,000 will be more than enough to continue to push it lower,? Peter Newland, an economist at Barclays Capital, said in a note to clients.

Reaction to the employment report on Wall Street was slightly negative. Stock index futures gave up early gains and were little changed shortly after the report came out. The yield on the benchmark 10-year Treasury note fell to 2.64 percent from 2.71 percent as investors bought U.S. government bonds.

The Federal Reserve will pay particularly close attention to the July employment data as it decides whether to scale back its $85 billion a month in bond purchases later this year. Weaker hiring could make the Fed hold off on tapering at its September meeting. However, economists noted that the drop in unemployment, along with steady hiring gains over the past year, could be enough to convince the Fed that the job market has made significant gains.

?While July itself was a bit disappointing, the Fed will be looking at the cumulative improvement,? said Paul Ashworth, chief U.S. economist at Capital Economics. ?On that score, the unemployment rate has fallen from 8.1 percent last August, to 7.4 percent this July, which is a significant improvement.?

Revisions showed employers added fewer jobs in the previous two months: May's job growth was downgraded to 176,000, below the 195,000 previously estimated; job gains in June were lowered to 188,000, from the 195,000 reported last month.

And the job gains in July were mostly in lower-paying industries, such as retail, hotels and restaurants.

But some were better-paying positions. Manufacturing added 6,000 jobs, driven by strong gains at auto plants. Those were the first job gains at U.S. factories since February. And professional services such as finance, accounting and information technology also increased.

Governments added jobs for the first time since April, driven by the fifth straight month of hiring by local government.

The economy grew at a subpar 1.7 percent annual rate in April-June quarter, the government said Wednesday. While that was an improvement over the previous two quarters, it's still far too weak to rapidly lower unemployment.

Recent data suggest that the economy could strengthen in the second half of the year.

A survey Thursday showed that factories increased production and received a surge of new orders in July, propelling the fastest expansion in more than two years.

The survey, by the Institute for Supply Management, also showed that the housing recovery is spurring more output by lumber companies, furniture makers and appliance manufacturers.

Businesses have ordered more industrial machinery and other equipment for four straight months. Europe's troubled economies are showing signs of recovery, potentially a lift to U.S. exports.

U.S. automakers are reporting their best sales since the recession, a sign that Americans are confident enough in their finances to make large purchases. Car sales rose 14 percent in July from 12 months earlier to 1.3 million.

Healthy sales have encouraged more hiring by Ford Motor Co. The company said last week that it will hire 800 salaried professionals this year, mostly in areas such as information technology, product development and quality control.

92% Frances Ha

All Critics (127) | Top Critics (36) | Fresh (117) | Rotten (10)

In your twenties you decide on the final version of you. Sophie is working on it; Frances is stuck in her crazy, clueless, can't-pay-the-rent stage.

It's a tribute to Gerwig's performance, somehow both clumsy and elegant, that she wins us over despite ourselves, that we come to appreciate her aimlessness in a goal-oriented society ...

This is an odd film (creepier than it knows), and even if you feel the atmospheric company of Dunham-ism, with a little of Whit Stillman, Henry Jaglom, and Woody Allen, the core influence on Noah Baumbach's film is fifty years older or more.

Baumbach usually builds his films around difficult protagonists, but Frances is entirely endearing, at once silly and deep, hopeless and promising.

The dialogue and editing are zippy and generally charming, combining with the tart observations of 20-something culture to create a nice frisson.

A black-and-white salute to the French New Wave (the score is borrowed from Georges Delerue, composer of many a Truffaut and Godard film) that manages to be very much of this moment ...

The sheer joy on Gerwig's face as she leaps and pirouettes across roads and between pedestrians is infectious.

There's little doubt that many people will find her insufferable, and almost everyone will experience moments of acute discomfort. But this is a wonderful performance that never becomes ingratiating.

Like Ethan Hawke's recent Before Midnight (aimed at people in their 40s), Frances Ha will engage its literate-minded target audience fed up with disaster blockbusters.

The hilarious, touching Frances Ha is lubricated by the same juice that allowed Jean-Luc Godard's Bande ? Part to slip so smoothly through the streets of Paris.

A film that's well aware of its own hipness, but never too cool to laugh and cry.

Frances Ha might well strike some viewers as ridiculously twee and tiresomely indulgent to its immature heroine. Not me, though. I'm happy to be enchanted.

Gerwig's last jaunt to Europe was in Woody Allen's feeble and disjointed To Rome With Love, and even Allen himself might acknowledge that here she is despatched across the Atlantic in a far more successful cause.

A perky cinematic pick-me-up starring the endearing Greta Gerwig who co-wrote the screenplay with director Noah Baumbach, her boyfriend.

I'm not sure what Noah Baumbach's Frances Ha is about, which is one reason I like it so much.

Frances is only adequate as a dancer but her enthusiasm bridges the gap between aspiration and ability. She deserves an A for effort. The film gets one for attainment.

It's a likable movie, with some nice moments of both comedy and pathos, and beautifully shot, but for me the reverence for its heroine was not completely earned, and the arrowhead was missing: the decisive jab of satire, of insight, of love.

This film may look like one of those annoyingly mannered independent films, with its wacky young cast and arty-farty black and white photography, but it's actually a fresh, smart and very funny comedy.

Noah Baumbach and Greta Gerwig have carved out, with effortless elegance and ease, a cinematic space for a woman to be, unapologetically, herself.

Frances Ha both acknowledges and earns its place in the tradition of the New York bourgeois comedy, encoding the angst of social mores in witty dialogue. Make no mistake: the cinematic slacker has come of age.

An unlikely feelgood crowd-pleaser - Frances Ha is sweet, funny, darling and almost unbearably lovely. And thankfully, everyone enunciates.

Brilliantly directed and beautifully shot, this is an utterly delightful, warm-hearted and very funny comedy with a wonderful script and a terrific central performance from Greta Gerwig.

Despite Gerwig's natural appeal and talent as a performer, Frances' self-absorption and flakiness begin to grate.

When is a film a throwaway sketch that's so good it's frameable? When it's Frances Ha.

Much of the reason why Frances Ha is a far more well-crafted and enjoyable piece of cinema than either Lola Versus or Damels in Distress.
