New laws ban employers from Facebook logins

With the start of the new year, some?states are just saying no?to employer snooping of employees' Facebook?accounts, with laws that prohibit bosses from being able to obtain your Facebook?login and password, as well as from getting?those for your?other social networking?accounts.

Six states???California, Delaware, Illinois, Maryland, Michigan and?New Jersey???passed such?laws, with Michigan's being the most recent. It was signed into law Friday by Gov. Rick Snyder, and took effect immediately.

Michigan's?law also "penalizes educational institutions for dismissing or failing to admit a student who does not provide passwords and other account information used to access private Internet and email accounts, including social networks like Facebook and Twitter," according to Reuters.

California and Illinois' laws take effect Jan. 1, and extends the employer?ban to job applicants.?California and Delaware are going another step farther, "prohibiting higher education?institutions from requiring students to disclose social media passwords or account information," according to the?National Conference of State Legislatures.

California's law also applies the social media password snooping ban to public employers, not just private ones.?

Last spring, Maryland became the first state to prohibit employer access to social media accounts, spurred by the frightening tale of Robert Collins,?a state Department of of Public Safety and Correctional Services worker who was told he had to turn over his Facebook password if he wanted to be reinstated to his job?after he returned from a leave of absence.

The ACLU of Maryland took up his cause, posting?a YouTube video?of his story.?As NBC News' Helen A.S. Popkin wrote at that time, "employers and colleges demanding Facebook passwords or other inappropriate access to social network profiles gained national attention" after?NBC News'?Bob Sullivan first broke the storyof the not-uncommon practice.?

Meanwhile, in Texas last month,?a state Senate bill,?S.B. 118, was introduced that would make it illegal for an employer to require or ask for access to employees' and job applicants' personal accounts "through electronic communication devices."

As the organization noted, 14?states "introduced?legislation?in 2012 that would restrict employers from requesting access to social networking usernames and passwords of applicants, students or employees."

But some of those states are not very far along, from Massachusetts, where a bill was filed last March, ?but little else done;?to?Missouri, where a similar bill was introduced, sent to a committee last April and hasn't been heard from since.

What it does in the course of telling a seminal story of our time is what contemporary films so rarely do, serve as brilliant provocation.

The genius of "Zero Dark Thirty" is that we feel exactly what those involved must have felt at the end. Not elation. Not the thrill of victory. Just relief.

A powerful, morally complicated work on an urgent subject. It is a film that deserves-that almost demands-to be seen and argued over.

Movies must move, and this one just lies there like a stack of paper from a classified government filing cabinet.

[Chastain's performance has] a lot of colors, and angles, and is guaranteed to be remembered come awards time. Maya's a real character, all right.

Kathryn Bigelow proves herself once again to be a master of heightened realism and narrative drive in this retelling of the decade-long search for Osama bin Laden.

It's like "All the President's Men" with torture and explosions, but no mention of presidents...

The decision one has to make is whether it's worth sitting through the first two hours, that provide a fine antidote for insomnia, to see the final 37 minutes.

A masterful piece of action filmmaking that succeeds in generating enormous tension by dramatizing a recent historical event in spite of the fact that everyone knows how it will end.

What makes the movie so effective is its protagonist, a doggedly determined CIA agent played by Jessica Chastain, who never loses sight of her goal in spite of repeated setbacks and bouts of political in-fighting.

The problem at the center of Zero Dark Thirty is that knowing and not knowing constitute a process, a process in which people tell lies and get hurt, in which costs can be overwhelming.

With a protagonist you lack the desire to root for and subject matter that's been shoved down our throats in the 11 years since 9/11, This is one of the only films this year where battling heavy eyelids is more exciting than the film itself.

The result is a remarkably thorough, unexpectedly cinematic, two-and-half-hour chronicle of American persistence.

There is something definitive about Zero Dark Thirty as a piece of filmmaking, as though Bigelow is concluding the entire ordeal for us on the big screen, as a film that could well earn her yet another Oscar.

While the film may not be the best of the year, its true winner is Jessica Chastain's knock-out, Oscar-worthy performance.

Zero Dark Thirty is a skillful -- and somewhat cautious -- look at military bureaucracy. It's both hampered and elevated by its dependence on authenticity.

Don't mess with the chicks. Osama bin Laden did, and look what happened to him.

Kathryn Bigelow's painstaking account of the events that led to the killing of Osama bin Laden favors dramatization over character and suspense.

There's no more perfect title for a film this year, because it manages to suggest a witching hour, a veil of deadly secrecy, and a pinpoint-honed logistical operation all at once.

A feverishly thrilling, decade-spanning CIA procedural.

This is next-level filmmaking -- smart, brave and intense.

Zero Dark Thirty has nary a wasted scene and very little in the way of respite from the intensity and power of its story and execution.

Achieves something rare, presenting a hot-button subject-torture-without the usual moral nudging.

Who's Accountable in Mayor Bloomberg's New York?

Mayor Bloomberg loves talking about "accountability." That's what teachers need. It's important, therefore, that we establish parameters that will ensure they are fired for no reason. This, of course, is why we're having conversations about judging teachers by test scores. The methodology is absurd, and does not reflect on how good or bad teachers may be, but at least it will guarantee some of them will lose their jobs.

It's another thing altogether when the fickle finger of fault is pointed toward Mayor Bloomberg. For one thing, he has all that money, and if that's the case, how could anything he does be considered "wrong?" When parents say, in the mayor's own survey, that class size is the most important issue to them, he conflates it with other issues and obfuscates the inconvenient truth with sheer nonsense.

And, when the NYC crime rate goes up, that's not his fault either. The crime rate went up, quite simply, because there are too many Apple devices on the streets, and people just can't keep themselves from swiping them. Apparently, these are otherwise honest, trustworthy citizens, and were it not for the abundance of iPhones on the street, they'd be pursuing one of the many minimum-wage, no-benefit jobs available at the many fast-food franchises that pepper our fair city. According to Mayor Bloomberg's conclusion, they would not be stealing your wallet, your car, your computer (unless it's a Mac), or your big-screen TV. They are driven to theft solely based on that Apple logo.

Oddly, when Mayor Bloomberg closes schools, it's no excuses. You can't say, "Gee, we've got a hundred alternate assessment students no one expected to graduate, and at least we trained them to work a job." That's unacceptable and your school must be closed. And where will those alternate assessment kids go? Well, not to Eva Moskowitz's joint, that's for sure. She doesn't buy into the nonsensical demands that her schools actually represent the population of the neighborhoods into which she's bullied her way. After all, that's how the schools she wants to replace get closed in the first place.

So ask not at whom the finger points, unionized teachers. It points at YOU.

'The Hobbit' stays atop box office for third week

(AP) ? "The Hobbit: An Unexpected Journey" continues to rule them all at the box office, staying on top for a third-straight week with nearly $33 million.

The Warner Bros. fantasy epic from director Peter Jackson, based on the J.R.R. Tolkien novel, has made $222.7 million domestically alone.

Two big holiday movies ? and potential awards contenders ? also had strong openings. Quentin Tarantino's spaghetti Western-blaxploitation mash-up "Django Unchained" came in second place for the weekend with $30.7 million. The Weinstein Co. revenge epic, starring Jamie Foxx and Christoph Waltz, has earned $64 million since its Christmas Day opening.

And in third place with $28 million was the sweeping, all-singing "Les Miserables." The Universal Pictures musical starring Hugh Jackman and Anne Hathaway has made $67.5 million since debuting on Christmas.

Coach cleared of child porn wants files sealed

(AP) ? Minnesota State University, Mankato, head football coach Todd Hoffner, who was cleared of child pornography charges last month that stemmed from videos found on his cellphone of his naked children clowning around after a bath, is suing to keep the police investigative reports sealed.

Hoffner has been taken off administrative leave, but he hasn't been reinstated as head coach and is facing a 20-day, unpaid school suspension in January for unspecified reasons. He sued the state and Blue Earth County earlier this month in an effort to keep the police reports private, after a Twin Cities television station asked to see them. The lawsuit seeks a temporary restraining order that would keep anyone from disseminating the investigative file.

District Court Judge Krista Jass ruled last week that the reports will remain private until they can be reviewed, the Mankato Free Press reported (http://bit.ly/ZFYA0c ),

Jass ordered prosecutors to gather all investigative reports and turn them over to Hoffner's attorney, Jim Fleming. He'll be allowed to file a sealed list of information that he believes should be kept from the public. After receiving Fleming's list, Jass will decide what should remain sealed.

Fleming said in a court affidavit that releasing the information would harm Hoffner.

"Plaintiff Mr. Hoffner has an ongoing investigation relative to his employment as a head football coach at (MSU)," Fleming's affidavit said. "Release of private non-public data could irreparably harm (Hoffner) with respect to that investigation that a civil lawsuit for damages would not fully compensate."

Hoffner was charged with child porn possession in August after school officials found videos of his naked children on his work-issued cellphone, which he had turned in to be repaired. Jass dismissed the criminal charges last month after concluding that the short videos of his children acting silly after a bath were not child porn and showed nothing illegal.

Last week, the university said it was suspending Hoffner without pay for 20 days starting Jan. 7. In its announcement, the university didn't say why it was suspending Hoffner, and school officials have declined to specify the reason.

An attorney for the union representing Hoffner has said the suspension is being challenged. The university also said last week it is still investigating a complaint against Hoffner.

Fleming told the newspaper that he wants the information sealed to protect Hoffner's privacy. Investigators went through computer files and took pictures of items in his house.

"We're not hiding anything from anybody," Fleming said.

More serious earthquakes predicted in the Himalayas

Dec. 28, 2012 ? A research team led by scientists from Nanyang Technological University (NTU) has discovered that massive earthquakes in the range of 8 to 8.5 magnitudes on the Richter scale have left clear ground scars in the central Himalayas.

This ground-breaking discovery has huge implications for the area along the front of the Himalayan Mountains, given that the region has a population density similar to that of New York City.

NTU Professor Paul Tapponnier, who is recognised as a leading scientist in the field of neotectonics, said that the existence of such devastating quakes in the past means that quakes of the same magnitude could happen again in the region in future, especially in areas which have yet to have their surface broken by a temblor.

Published recently in Nature Geosciences, the study by NTU's Earth Observatory of Singapore (EOS) in Singapore and colleagues in Nepal and France, showed that in 1255 and 1934, two great earthquakes ruptured the surface of the earth in the Himalayas. This runs contrary to what scientists have previously thought.

Massive earthquakes are not unknown in the Himalayas, as quakes in 1897, 1905, 1934 and 1950 all had magnitudes between 7.8 and 8.9, each causing tremendous damage. But they were previously thought not to have broken the earth's surface -- classified as blind quakes -- which are much more difficult to track.

However, Prof Tapponnier said that by combining new high resolution imagery and state of the art dating techniques, they could show that the 1934 earthquake did indeed rupture the surface, breaking the ground over a length of more than 150 kilometres, essentially south of the part of the range that harbours Mt Everest.

This break formed along the main fault in Nepal that currently marks the boundary between the Indian and Asian tectonic plates -- also known as the Main Frontal Thrust (MFT) fault.

Using radiocarbon dating of offset river sediments and collapsed hill-slope deposits, the research team managed to separate several episodes of tectonic movement on this major fault and pin the dates of the two quakes, about 7 centuries apart.

"The significance of this finding is that earthquakes of magnitude 8 to 8.5 may return at most twice per millennium on this stretch of the fault, which allows for a better assessment of the risk they pose to the surrounding communities," said Prof Tapponnier.

Prof Tapponnier warns that the long interval between the two recently discovered earthquake ruptures does not mean people should be complacent, thinking that there is still time before the next major earthquake happens in the region.

"This does not imply that the next mega-earthquake in the Himalayas will occur many centuries from now because we still do not know enough about adjacent segments of the MFT Mega-thrust," Prof Tapponier explains.

"But it does suggest that areas west or east of the 1934 Nepal ground rupture are now at greater risk of a major earthquake, since there are little or no records of when last earth shattering temblor happened in those two areas."

The next step for Prof Tapponnier and his EOS scientists is to uncover the full extent of such fault ruptures, which will then allow them to build a more comprehensive model of earthquake hazard along the Himalayan front.

Smart TV owners tuning out most apps

They may be called smart TVs, but that doesn?t stop the vast majority of us from using them as basic boob tubes. A new NPD Group report claims that most people use their Internet-enabled televisions to stream video services like Netflix or Hulu Plus, and?? actually, not much else.

Streaming music services manage to entertain around 15 percent of smart TV owners, but all of the more ballyhooed interactive aspects of Internet-enabled TVs???think Facebook, Twitter, Web browsers, and all those apps, games, and email widgets that come preloaded in newer HDTVs???are left completely untouched by most people.

The NPD Group?chalks the trend?up to a few different factors, the biggest of which being the simple fact that most people consider televisions sets to be, well, televisions???not computing devices. The proliferation of secondary Internet-enabled devices (like consoles and Blu-ray players) and the rise of local digital streaming options (like AirPlay, DLNA, and Samsung AllShare) may also be both confusing customers and cannibalizing traditional smart TV services, NPD theorizes.

We?ll add another possible factor: The molasses-slow processors in most smart TVs make anything beyond simple content streaming a major usability pain. Trying to browse your Facebook News Feed on a television is often a tremendously laggy exercise in frustration.

Fortunately, consumer disinterest in the Internet-enabled bells and whistles may just make the basic video-streaming functions of smart TVs more pleasant to use going into the future???at least if manufacturers listen to the NPD?s closing advice: ?Focus less on new innovation in this space and more on simplification of the user experience.?

Renters are oft-overlooked victims of foreclosure.

A recent study by the National Law Center On Homelessness and Poverty points out that roughly 20% of all foreclosed properties are rental properties.

Visualize this:

You are a renter who has signed a one-year lease, put up a substantial security deposit, moved in, and think you?re all settled for the next twelve months.

Then, two months into your lease, you learn that the property you?re renting just went into foreclosure.

Or, worse, you learn that the property was already in foreclosure when you signed the lease.

Another few months pass, and a sheriff?s deputy knocks on your front door and tells you that you must leave within three days.

You have to move, your deposit is gone, and the landlord has pocketed your rent while not making mortgage payments.

It?s not fair, but it can happen.

Renters in these circumstances are innocent victims and vulnerable through no fault of their own.

Before you sign that lease, check the public records ?and confirm that a notice of default has not been recorded against the property you want to rent.

That will, at least, confirm that the property is not in foreclosure proceedings when you sign the lease.

You can do this by contacting your county recorder?s office in most locales.

Eating asparagus may prevent a hangover, study suggests

Dec. 26, 2012 ? Drinking to ring in the New Year may leave many suffering with the dreaded hangover. According to a 2009 study in the Journal of Food Science, published by the Institute of Food Technologists (IFT), the amino acids and minerals found in asparagus extract may alleviate alcohol hangover and protect liver cells against toxins.

Researchers at the Institute of Medical Science and Jeju National University in Korea analyzed the components of young asparagus shoots and leaves to compare their biochemical effects on human and rat liver cells. "The amino acid and mineral contents were found to be much higher in the leaves than the shoots," says lead researcher B.Y. Kim.

Chronic alcohol use causes oxidative stress on the liver as well as unpleasant physical effects associated with a hangover. "Cellular toxicities were significantly alleviated in response to treatment with the extracts of asparagus leaves and shoots," says Kim. "These results provide evidence of how the biological functions of asparagus can help alleviate alcohol hangover and protect liver cells."

Asparagus officinalis is a common vegetable that is widely consumed worldwide and has long been used as an herbal medicine due to its anticancer effects. It also has antifungal, anti-inflammatory and diuretic properties.

I have been looking online for different doctors in the area who will do an allergy testing procedure. I am not quite sure what it is that I am allergic to. However, something is really making me sick. I was talking with a friend of mine last week and she told me that an allergy doctor would be able to run some tests and hopefully figure out the problem. I am glad that she gave me this information. Now, I just need an appointment.

Transfusions add risk in some heart attacks, finds study of patients with anemia

Dec. 24, 2012 ? When heart attack patients present in the emergency department with some degree of anemia, or anemic patients have a heart attack, physicians have a tendency, but not much guidance, about whether to provide a blood transfusion. The idea is that a transfusion could help more oxygen get to the heart. Recent national guidelines suggested that there simply isn't good evidence to encourage or discourage the common practice, but a new meta-analysis of 10 studies involving more than 203,000 such patients comes down on the side of it increasing the risk of death.

The next step for determining when the practice could be appropriate needs rigorous randomized trials that will generate more decisive, high-quality data, said lead author Dr. Saurav Chatterjee, a cardiology fellow at the Alpert Medical School of Brown University and the Providence VA Medical Center.

For the analysis published Dec. 24 in the Archives of Internal Medicine, Chatterjee and his co-authors combined and analyzed data from studies in which anemia patients with heart attacks either received "liberal" transfusions or received more restricted versions of the treatment or no transfusions at all. Liberal transfusions were defined as cases in which patients either received two units of blood or more or had a transfusion even with a hematocrit reading (a measure of red blood cell concentration) higher than 30 percent (normal is in the low 40s).

What the researchers found, after statistical adjustments to control for important medical factors, was that the risk of death was 12 percent higher for people who received the liberal transfusions than those who did not. Moreover, the group that received liberal transfusions had twice the odds of having another heart attack.

"What we found is that the possibility of real harm exists with transfusion," Chatterjee said. "It is practiced in emergency departments all across the United States. I think it is high time that we need to answer the question definitively with a randomized trial."

Of the 10 papers that Chatterjee and his co-authors reviewed, all but one were observational studies. The only randomized trial was a small pilot experiment.

Searching for an answer

Chatterjee began the study when he was a resident at Maimonides Medical Center in New York. He noticed a paper by the AABB (formerly the American Association of Blood Banks) in which the association said there was not enough clinical evidence for or against transfusions in heart attack patients.

For clinicians, the practice has always been a tough judgment call. Some transfusions are clearly necessary, for example when a patient's troubles include not just a heart attack but also severe ongoing bleeding, Chatterjee said. But transfusions also create health risks, such as an increase in potential clotting because platelets may clump together more, or from an inflammatory immune response to the introduction of blood of a "foreign" source into the body.

Chatterjee and his co-authors decided to comb the literature to determine whether, if properly combined and analyzed, existing data could provide some insight. They found 729 potentially relevant studies, but only 10 that had the right data to help answer the question.

Few as they were, Chatterjee said, the studies all told much the same story.

"One of the things that struck us is that there were very few studies in evidence of transfusion at all," Chatterjee said. "In our case, though, we found that the effect was pretty consistently harmful across the spectrum of studies, spectrum of time, and spectrum of patients that were enrolled in the individual studies."

Chatterjee said the study should not be taken to mean that transfusions should be stopped altogether for anemic heart attack patients. Instead, he said, doctors must continue exercising their clinical judgment, at least until results from a large, well-designed randomized trial can be produced. Mindful of the risk his study found, however, they might just want to shift their thinking about where the border is among borderline cases.

"Before a definitive trial is out there, we should be conservative, especially considering the high risk of harm," he said.

In addition to Chatterjee, the paper's other authors are Jorn Wetterslev of the Centre for Clinical Intervention Research in Copenhagen, Denmark; Abhishek Sharma and Edgar Lichstein of Maimonedes Medical Center; and Debabrata Mukherjee of Texas Tech University.

Holleh Nowrouz, a 26-year-old who ran the social media for the struggling Sale Shark rugby team, learned this obvious lesson the hard way after posting on her own personal Facebook:

"Oh, the joys of managing a sport club's social media when we've lost the last seven Premiership home games. To the Sale Sharks fans who comment about the club needing to spend less time blogging and tweeting and more time coaching, the staff who create content for the website and social media platforms are not the same members of staff who coach the team. You absolute f---wits."

Although the rant was posted in October, a fan noticed it and placed it on the team's page last week. The British team fired Nowrouz shortly after discovering the post.

Employees need to learn that their Facebook identities will be used against them in the workplace.

A staff member for the social media agency working on the Montana Tourism account was recently fired for writing "F this job" on the state's Facebook page?instead of her own.

She wrote: "F this job. I just want to live in Whitefish with my future husband. Leaving Bozeman for good tomorrow. I love you with all my heart and you are not leaving me. Never. Thanks for the good times MercuryCSC!"

Objective:Endometrial cancer is one of three gynecologic malignanttumors, including cervical cancer and ovarian cancer. In recent years, themorbidity is increasing and it seriously endangers the health of women. But itspathogenesis is not yet clear. It is believed that exposure to endogenous orexogenous estrogens, which is not opposed by progesterone, increases the riskof developing endometrial cancer. Estrogen related intracellular metabolismincludes cytochrome P4501B1(CYP1B1)-mediated oxidation (mainly for thehydroxylation) and catechol-O-methyltransferase (COMT)-mediatedmethylation. Cytochrome P4501B1(CYP1B1) is involved in estrogenmetabolism? whose metabolites are associated with the initiation andprogression of cancer. catechol-O-methyltransferase (COMT) convertsestrogen metabolites to nontoxic substances and cleans them out of body. Theaim of the study was to detect CYP1B1, COMT cell localization in cell andexpression difference between endometrial cancer and normal endometrium,then to explore the significance of both in endometrial cancer progression,then to provide a new idea to dometrial cancer etiology, diagnosis andtreatment.Methods:Total40Endometrial cancer tissues were collected aftersurgery and were confirmed by pathology in the department of Gynecologyand Obstetrics in the4th hospital of Hebei Medical Universiry.Total35normal endometrium tissues were chosen in the same area as control group(from patients of cervical carcinoma, without uterine fibroids, endometrialhyperplasia, ovarian cancer and other related gynecological diseases). Alltissues were stored in10%formalin, were made into wax block after7days.Immunohistochemistry (SP) was used to detect the expression of CYP1B1andCOMT. The Olympus DP70imaging system was used to take pictures. Stained specimens was analysised by image analysis system Image-ProPlus5.1(USA). Statistical analysis was performed using SPSS13.0softwarepackage. Comparison of two groups was performed by t-test and three groupsby the One-Way ANOVA. Comparison of two groups, with uneven variance,was performed by the non-parametric test. P<0.05was considered significantfor all statistical analysis.Results:1CYP1B1and COMT were expressed in cell plasma, few in theinterstitial and (or) glandular cell nuclear. This study was mainly to comparethe expression in the cytoplasm of glandular epithelial cell.2The age difference was not significant between the endometrial cancerpatients and healthy controls.The distribution of CYP1B1and COMTexpressions in the case and control groups were normal.3The mean optical density (OD) of CYP1B1in the case group?0.259?0.044? was significantly higher than that in control group?0.169?0.184?, the difference was statistically significant (P=0.000);While the OD of COMT in the case group ?0.208?0.058? was lower thanthat in control group, the difference was statistically significant (P=0.000).4The expression of CYP1B1were significantly different in differentstages of endometrial carcinoma (P<0.05), and the more advanced stage, thestronger the expression was. In the case group, CYP1B1expression in ERpositive group was stronger than in ER negative group. The expression ofCOMT in P53positive group was stronger than in P53negative group (P=0.035).5The expresstion of CYP1B1and COMT had positive linear correlationin the control group(r=0.384, P=0.025).Conclusions:1The expression of CYP1B1in endometrial cancer tissues was higherthan that in the normal tissues, indicating that CYP1B1may play an importantrole in the occurrence of endometrial cancer, which provide a new way ofdiagnosis, treatment and prognosis about endometrail cancer. 2With ER expression increased gradually, CYP1B1expression showeda rising trend, suggesting that CYP1B1may be regulated through ER pathway.3The expression of CYP1B1in endometrial cancer tissues was strongerthan that in the normal tissues, suggesting that CYP1B1may be used as theprognosis indicator of endometrial cancer.4The expression of COMT in control group was higher than that in thecase group, implying that COMT may play a protective role in endometrialcancer occurrence and development.5The expresstion of CYP1B1and COMT had positive linear correlationin the control group, indicating that both coordinates to maintain the normalestrogen metabolism, and to prevent excessive production of carcinogens.
